Refund Policy

1. Scope

(1) This Refund Policy applies to all paid services purchased via the web application Heyblocks, in particular subscriptions (Student, Pro).

(2) The provider of the services is:

2. Subscriptions & right of withdrawal

(1) Heyblocks is a service that exclusively provides digital content and services. Subscriptions are activated immediately upon conclusion, and access to the selected subscription tier is unlocked instantly.

(2) Pursuant to Section 356(5) BGB, the statutory right of withdrawal for digital content expires as soon as the provider has begun performance of the service, after the user has:

  • expressly consented to the provision of the service beginning before expiry of the withdrawal period, and
  • confirmed their awareness that, by giving this consent, they lose their right of withdrawal.

(3) Since access is unlocked immediately upon conclusion of the subscription, the right of withdrawal expires upon activation.

3. Cancellation of subscriptions

Principle: Subscriptions can be cancelled at any time effective at the end of the current billing period.

(1) Cancellation is carried out via the customer portal in the application („Manage subscription“). After cancellation, access remains in place until the end of the already-paid billing period.

(2) After the paid period has elapsed, the account is reset to the free Free tier.

(3) Subscription fees already paid for the current billing period are, as a matter of principle, not refunded. This also applies in the case of early cancellation within a paid month.

4. Exception: Technical malfunctions

Exception: In the case of technically failed processing operations, the usage time consumed is not counted against the quota.

(1) If a processing operation fails due to a technical error on the part of Heyblocks or an integrated third-party service provider, the usage time allocated for it is not deducted from the user's quota.

(2) A failed processing operation exists when:

  • the processing of the source (audio, video, text, URL, research) was not completed and no result was produced
  • a system error occurred during AI processing that led to an incomplete or empty result

(3) No refund or credit is granted if the processing was technically completed successfully, but the user is not satisfied with the content of the AI result. The quality of AI-generated content is not subject to any guarantee (cf. Terms of Service, Section 3).

5. Technical malfunctions & unavailability

(1) Heyblocks endeavors to ensure a high availability of the application. However, a particular availability is not guaranteed (cf. Terms of Service, Section 10).

(2) Temporary unavailability of the application due to maintenance work, technical malfunctions, or outages at third-party providers (e.g. OpenAI, Cloudflare, Railway) does not give rise to any claim to a refund of subscription fees or an extension of the billing period.

(3) In the case of persistent, serious impairments, Heyblocks reserves the right to grant affected users appropriate compensation on a case-by-case basis (e.g. extension of the billing period). There is no legal entitlement to this.

6. Payment processing & Stripe

(1) All payments are processed via the payment service provider Stripe Inc. Heyblocks has no access to complete payment data (e.g. credit card numbers).

(2) In the case of a refund granted by way of exception, this is made to the payment method originally used for the payment. The processing time depends on the respective payment provider and generally amounts to 5–10 business days.

(3) Stripe-specific fees incurred during payment processing may, on a case-by-case basis, be deducted from the refund amount, provided that Stripe does not refund them.

7. Legacy balance (Grace Credits)

(1) Users who acquired credits before the introduction of the subscription model receive these as a legacy balance (Grace Credits).

(2) The legacy balance is consumed with priority over the subscription quotas and does not expire.

(3) The legacy balance is non-refundable, non-transferable, and cannot be converted into cash. Upon deletion of the user account, the legacy balance expires without compensation.

9. Withdrawal Instructions

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.

In order to exercise your right of withdrawal, you must inform us

by means of a clear declaration (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification regarding the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you all payments that we have received from you, without undue delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract was received by us. For this repayment, we will use the same payment method that you used in the original transaction, unless something different was expressly agreed with you; in no case will you be charged any fees on account of this repayment.

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of withdrawal with regard to this contract, compared with the total scope of the services provided for in the contract.

Early expiry of the right of withdrawal

The right of withdrawal expires early if we have fully performed the service and have begun performance of the service only after you have given your express consent to this and at the same time confirmed your awareness that you lose your right of withdrawal upon complete performance of the contract (Section 356(5) BGB).

11. Changes to this Policy

(1) Heyblocks reserves the right to amend this Refund Policy at any time. Material changes will be communicated to users in an appropriate manner (e.g. by e-mail or in-app notice).

(2) The current version is always available in the application. For subscriptions concluded before a change, the version valid at the time of conclusion applies until the end of the current billing period.
